Welcome to MoVa. Throughout the site, the terms “we”, “us” and “our” refer to MoVa. MoVa operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). MoVa is powered by Shopify, which enables us to provide the Services to you.
The following terms and conditions, together with all policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and obligations when using the Services.
Please read these Terms carefully, as they include important information about your legal rights, including disclaimers and limitations of liability.
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use our Services.

By agreeing to these Terms, you confirm that you are at least the age of majority in your country of residence.

By placing an order, you make an offer to purchase a product.

Returns and refunds are governed exclusively by our Return Policy.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
MoVa operates on Shopify. However, all transactions are between you and MoVa.
Shopify is not responsible for any issues related to purchases.

All personal data is handled in accordance with our Privacy Policy.

SECTION 11 – FEEDBACK
Any feedback you provide may be used by us without restriction or compensation.

SECTION 12 – ERRORS AND OMISSIONS

SECTION 14 – AGENTS
14.1 This section (“Agent Terms”) applies if you use, permit, enable, or cause an Agent to access, use, or interact with the Services. “Agent” means any software or service that acts autonomously or semi-autonomously on behalf of, or under instructions from, a person or entity, and that may be run without direct supervision on behalf of a person or using that person’s device.

14.2 No Agent may access, use, or interact with the Services unless it identifies itself at all times and acts in strict compliance with the requirements set out in Section 14.4 below. In addition, no Agent may access, use, or interact with the Services if we have instructed it to cease such access, use, or interaction.
14.3 We may restrict, including through technical measures, whether and how an Agent may access, use, or interact with the Services.

14.4 Agents:  (i) must indicate in all HTTP/HTTPS requests that the request originates from an Agent and disclose the name of the Agent by including the following in the request’s user-agent string: “Agent/[AgentName]”;  (ii) must not conceal or obscure that access, use, or interaction originates from an Agent, including by:  (a) imitating human behaviour or interaction patterns; or  (b) completing or bypassing CAPTCHAs or other measures intended to distinguish between human and computer use;  (iii) must respond truthfully to any questions or requests intended to determine whether interactions originate from a human or a computer;  (iv) must not circumvent or otherwise avoid any measures intended to prevent, restrict, modify, or control whether and how Agents may access, use, or interact with Shopify Consumer Services.

We may terminate access at any time without notice.

SECTION 16 – DISCLAIMER OF WARRANTIES
Services are provided “as is” without warranties, except where required by law.

SECTION 17 – LIMITATION OF LIABILITY
To the extent permitted by law, we are not liable for indirect or consequential damages.
Nothing in these Terms limits liability where it cannot legally be excluded (e.g. under applicable consumer law).

You agree to indemnify MoVa against claims arising from your misuse of the Services.

These Terms constitute the entire agreement between you and MoVa.

SECTION 21 – ASSIGNMENT
You may not assign your rights under these Terms without consent.

SECTION 22 – GOVERNING LAW
These Terms are governed by the laws of Germany.
If you are a consumer residing in the European Union or the United Kingdom, you also benefit from any mandatory provisions of the law of your country of residence.

SECTION 23 – HEADINGS
Headings are for convenience only.

SECTION 24 – CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Services constitutes acceptance.
